Datum20 is an AI-powered project document assistant designed for architecture, engineering, and construction (AEC) professionals. The platform uses artificial intelligence to analyze uploaded project documents and provide responses to user queries based on that document content.

Datum20 is an informational reference tool only. It is not a licensed design professional, a code-compliance authority, a substitute for the architect/engineer of record, or a replacement for professional judgment of any kind.

All responses, summaries, pre-screens, and outputs generated by Datum20 (including those from the “Clarity” AI assistant) are AI-generated and may contain errors, omissions, or inaccuracies. AI technology, while powerful, is not infallible and can misinterpret, misquote, or incompletely represent information contained in project documents.

Users must independently verify all AI-generated information against the official contract documents, project specifications, approved shop drawings, and any other authoritative project records before taking any action based on such information.

To the fullest extent permitted by applicable law, Datum20 and its owners, operators, officers, directors, employees, agents, licensors, and affiliates (collectively, “Datum20 Parties”) shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:

• Any errors, inaccuracies, or omissions in AI-generated content
• Any decisions made or actions taken based on information provided by the platform
• Any construction defects, rework, delays, cost overruns, or injuries resulting from reliance on AI-generated responses
• Any failure to identify conflicts, discrepancies, or code violations in project documents
• Any misinterpretation of specifications, drawings, or other contract documents
• Loss of data, revenue, profits, or business opportunities
• Any third-party claims arising from use of the platform

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether or not Datum20 Parties have been advised of the possibility of such damages.

The platform is provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise. Datum20 Parties specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, and any warranties arising out of course of dealing or usage of trade.

Datum20 does not warrant that:

• AI-generated responses will be accurate, complete, current, or error-free
• The platform will identify all relevant information in uploaded documents
• The platform will detect conflicts, errors, or omissions in project documents
• The service will be uninterrupted, timely, secure, or free of viruses or other harmful components

You agree to indemnify, defend, and hold harmless the Datum20 Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

• Your use of the platform or any AI-generated content
• Any actions taken or decisions made based on information from the platform
• Any construction work performed using information obtained through the platform
• Your failure to independently verify AI-generated content against official contract documents
• Any violation of these Terms of Use
• Any third-party claims arising from your use of the platform

By using Datum20, you acknowledge and agree that:

• You are a qualified professional or are working under the supervision of qualified professionals in the AEC industry
• You understand the inherent limitations of AI technology and will exercise professional judgment when using AI-generated content
• You will always verify AI-generated responses against official contract documents, approved submittals, and applicable codes before taking any action
• You will not rely solely on AI-generated content for any decision affecting life safety, structural integrity, code compliance, or regulatory requirements
• You are solely responsible for any construction decisions, material selections, installation methods, or other actions taken based on information obtained from the platform
• The architect/engineer of record remains the final authority on all design and specification matters
• You will maintain your own independent records and not use Datum20 as a document of record

The AI-powered submittal pre-screen feature is designed to provide a preliminary, automated review only. It does not constitute a formal submittal review by the architect/engineer of record and does not replace the contractual review process.

All submittals must still be formally reviewed and approved through the established project review process in accordance with the contract documents and applicable professional standards.

RFI drafts and field report documents generated through Datum20 are convenience tools only. Generated documents may reference AI-interpreted content and should be thoroughly reviewed for accuracy before distribution.

Users are responsible for verifying all content within generated documents, including referenced specifications, drawing numbers, and technical details, before submitting them as part of the formal project record.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from the use of this platform shall be resolved through binding arbitration, unless otherwise required by law.

Datum20 reserves the right to modify these Terms of Use at any time. Continued use of the platform after changes are posted constitutes acceptance of the modified terms. Users are encouraged to review these terms periodically.
